IRIDIUM SATELLITE PHONE RENTAL AGREEMENT

TERMS OF RENTAL

This agreement is between Planet Earth Adventures, LLC. and the customer digitally signing below and purchasing the rental of satellite equipment via discoverak.com hereby referred to as RENTER. This agreement is valid until the rented satellite phone and equipment is returned to Planet Earth Adventures, LLC. and all agreed upon fees have been paid in full.

STANDARD RENTAL EQUIPMENT

The following standard equipment has been or will be provided to the customer as part of this Agreement. Proof of delivery and return will be provided by both parties through execution of a delivery receipt or signed delivery via common courier. If additional equipment / accessories are provided and/or selected by the customer, customer will pay additional rental charges.

STANDARD EQUIPMENT INCLUDES:

  • Satellite Phone with Battery

  • Pelican 1200 Case

  • AC Charger

  • User Guide

  • Leather Case

(Stipulated equipment value of Standard Equipment is $1,500 for the 9555 or the Iridium Extreme)

RENTAL PERIOD

The rental period begins on the date that PLANET EARTH ADVENTURES, LLC. delivers the satellite equipment to the RENTER and continues for the amount of time the RENTER purchases at the time the order is placed. The rental period may not be shortened or extended. If rented equipment is not returned by the end of the rental period Late Fees will be added to the final rental bill as described below.

SECURITY DEPOSIT/RESERVE

A reserve against the Customer’s credit card will be made on, or before the Effective Rental Date. Currently Planet Earth Adventures, LLC. charges $1000.00 for the Iridium 9575 or 9555 as a security reserve. This reserve will be maintained by Planet Earth Adventures, LLC. and will be applied against any default of Customer in payment of rent or for damage or loss of the Equipment or other payment due Planet Earth Adventures, LLC. which is chargeable to the Customer. If the customer believes they may be late in returning the equipment, they must notify Planet Earth Adventures, LLC. prior to the expiration of the contracted rental period, or the phone’s airtime may be suspended (which will render the phone inoperable). If the customer is more than one week late, the security reserve will be captured until the equipment is returned. When the equipment has been returned, the security reserve will be credited back to the customer minus all charges that have been incurred including any late fees and costs of the additional week(s) that rental was out. Upon termination of this Agreement, and after final airtime and other charges are paid in full, the remainder of the reserve will be released from the credit card.

AIRTIME BILLING

Airtime charges for rental periods of one month or less will be billed at the end of the rental period at the our current published rate for the equipment being rented and will be due immediately to Planet Earth Adventures, LLC. Airtime charges for rental periods of more than one month may be collected on a monthly basis or at the end of the rental period and will be due immediately once the airtime bill is generated. If the RENTER prepays for any airtime at the inception of the rental period then only the airtime exceeding the prepaid amount will be billed. Unused prepaid airtime is not refundable. POSTPAID AIRTIME unless otherwise specified. Our Iridium satellite phone rentals automatically come with postpaid airtime (at our standard rental rate of $1.79/minute). The rate per minute applies to all outgoing calls worldwide - voice & data from the Iridium phone to any terrestrial destination throughout the world *(also to another Iridium phone). There are no additional charges or roaming charges (excluding taxes).

DATA TRANSMISSION USE AND DROPPED CALLS

Due to the technical nature of data setups and the inherent sophistication of data transmission through a variety of operating systems, Planet Earth Adventures, LLC. makes no representation as to the success of data calls through the Iridium Satellite Network. Customer agrees that all data call attempts regardless of ultimate successful transmission and termination will be paid for and no credits will be given in the event of dispute of this nature. Along with potential incorrect use (i.e.: next to a building/obstruction), the Iridium system (a low earth orbiting satellite constellation) has inherent flaws and anomalies that can create dropped calls of either voice or data nature. Dropped calls will not be credited. Planet Earth Adventures, LLC. can provide data setup technical support beyond the normal provided setup instructions at an additional charge. Please consult with a sales representative for more details.

SATISFACTION OF SERVICE

Planet Earth Adventures, LLC cannot guarantee that the RENTER is satisfied with the quality of service. Planet Earth Adventures, LLC is obligated to deliver working satellite equipment to the RENTER by the date that the RENTER has indicated they need the satellite equipment. If the RENTER feels they have a non-working satellite phone or terminal they may be eligible for a refund. In such a case the RENTER must report the defect to Planet Earth Adventures, LLC and return the satellite equipment within 48 hours of receiving it. Planet Earth Adventures, LLC will test the equipment that the customer has claimed to be defective and if it found to be defective the renter will not be responsible for the rental fees. If the equipment is found to be in working condition or if the above procedure is not followed the RENTER will still be obligated to pay for all rental charges. Planet Earth Adventures, LLC strongly advises that the RENTER make arrangements to receive the equipment far enough in advance of their trip that they would have sufficient time to test the equipment before their departure. Planet Earth Adventures, LLC makes every effort to work with customers to help them understand how to use their satellite phone or terminal and troubleshoot any apparent problems prior to the RENTER's departure.

LOSS OR DAMAGES

All rented equipment must be returned to Planet Earth Adventures, LLC. in the same condition in which it was shipped. If any of the rented equipment is broken, damaged, stolen, lost or missing the RENTER is responsible for paying Planet Earth Adventures, LLC. for a replacement or repair fee equal to the current retail price of the damaged or missing equipment. If the RENTER purchases rental insurance at the time of the inital order then their equipment can be returned in a damaged or broken condition with out penalty, but ALL equipment rented must still be returned. Rental insurance does not cover loss or theft. The RENTER understands that he or she is responsible for the full replacement cost of the equipment should it not be returned. If returned equipment appears broken due to misuse, a test and repair charge of up to $350.00 may be charged for inspection, testing and minor repairs required to return the Equipment to service. This charge will be payable at the end of this Agreement. If the phone can not be repaired, the customer will be notified and will be responsible for the designated replacement cost of the phone.

LATE FEES AND CANCELLATION FEES

Planet Earth Adventures, LLC. allows a three day grace after the end of the rental period before applying late fees. The RENTER is obligated to pay a late fee of $20 per day for every day the satellite equipment is not returned after the rental period and the three day grace period. Planet Earth Adventures, LLC. will not charge a cancellation fee if the RENTER cancels the order more than 4 business days prior to the scheduled delivery of the equipment. If the RENTER cancels within 3 business days of the scheduled delivery of the order, Planet Earth Adventures, LLC. will apply a cancellation fee to the order equal to 50% of the order total.

PICK-UP AND DROP-OFF LOCATIONS

We service the Anchorage and Talkeetna areas only. Satellite phones can be picked up and/or dropped off at your hotel, air taxi service provider or other Anchorage locations. Please call us to arrange pick up and drop off location. We do not ship phones to other locations in Alaska. In Talkeetna, we can arrange satellite phone rental pick up at Talkeetna Air Taxi only. Please call us before renting a phone to make sure that we have a unit available for you in Talkeetna.
